Biden-Harris DOJ Mandates Changes to Maryland State Police Hiring Practices

Summary

The Biden-Harris administration’s Department of Justice (DOJ) has mandated significant changes to the hiring practices of the Maryland Department of State Police (MDSP) following allegations of discriminatory testing procedures. As part of a settlement agreement with the DOJ, MDSP will pay over $2 million in back pay to female and Black applicants who failed to meet the agency’s previous testing standards, which were found to disproportionately affect these groups.

The DOJ’s investigation revealed that the MDSP’s written and physical tests violated Title VII of the Civil Rights Act by creating barriers for Black and female applicants. For instance, while approximately 91% of white applicants passed the written Police Officer Selection Test (POST), only about 71% of Black applicants succeeded. Similarly, the Functional Fitness Assessment Test (FFAT) showed a significant disparity, with only 51% of female candidates passing compared to 81% of male candidates. In response to these findings, the DOJ has required the MDSP to revise its testing standards, ensuring they accurately assess the capabilities necessary for law enforcement roles without discrimination. The settlement also includes provisions for hiring up to 25 previously disqualified applicants who can pass the new selection process.
